Full payment must be made before I begin your commission. Once the sketch has started, refunds are not allowed, so if you need to cancel your commission, please let me know before I begin working on it. I do not offer refunds past the sketch stage under any circumstances. If a client attempts to force a refund after this point—through PayPal or any other platform—they will be permanently banned from commissioning me or using my artwork in the future.In the event of a cancellation after I have already started working — whether it is a commission, an art trade, a collaboration, artwork done as part of a project, or a drawing agreed upon as payment — the client or collaborator has no authorization to use the artwork, concepts, or progress in any way. I, as the artist, retain full rights over any unfinished work. While I will never use your characters without permission, I reserve the right to reuse elements such as poses, compositions, or lineart for future works (for example, repurposing a pose for a YCH), but always with different characters and never with the cancelled project’s original content.
The turnaround time (TAT) for commissions is typically 1–2+ months, but this may vary depending on the complexity of the piece or external factors. Please keep in mind that I am a student, and I also have to manage classes, homework, and personal responsibilities. I truly appreciate your patience and understanding during the process.Throughout the commission, I’ll provide updates and WIPs to keep you informed. You may request 3–5 changes during the sketch phase, but I will not accept radical changes once the artwork is almost or fully finalized. If you're unsure of what you want, I'm open to artistic freedom, but I still ask for a clear direction or mood so I can create something that matches your vision. Any necessary color corrections will be done before finalizing the piece.If your commission has a strict deadline, we can discuss it in advance. Please note that requesting a due date may involve an additional fee depending on the complexity or urgency. In some cases, requests involving complex elements, gore or detailed designs may also require an additional charge. These costs will always be discussed and agreed upon before I begin. If you're requesting a piece with more than one character, keep in mind that each extra character costs the same as the base price (e.g., a $18 flat-color bust will cost $36 with two characters, $54 with three, and so on).Once the commission is complete, please do not crop out my signature, and make sure to credit me as Pabiis if you post the artwork online. I reserve the right to post the commission on my social media or include it as an example in my portfolio. However, if the client wishes for the commission to remain private and not be shared publicly, this must be clearly requested and an additional fee will apply. This fee serves as confirmation and proof of the agreement for privacy through the payment receipt. Once the payment is received, I, as the artist, commit to not sharing or publishing the commission in any way, as per the terms agreed upon with that payment.Regarding usage, all commissioned pieces are for personal, non-commercial use by default. If you wish to use the artwork commercially, an extra fee will apply. This can be either a flat rate or a percentage of profits, depending on the type of usage and what we agree upon. Unauthorized commercial use is strictly prohibited. This also applies to adoptables and custom designs — they do not come with commercial rights unless explicitly purchased.For adoptables and customs, unless the commercial rights are purchased, they are strictly for personal use only. This means the design cannot be used in merchandising, or in any project that generates profit. If you wish to use the design commercially, you may purchase commercial rights either at the time of purchase or at a later date. The fee can be a flat rate or a percentage of profits, depending on the agreement. Unauthorized commercial use is strictly prohibited on all my work if not formally pruchased.These terms also apply to adoptables and customs even if redesigned. You are welcome to redesign the character, but it must remain recognizable and true to the original concept. However, you do not have permission to create a species based on any of my designs, adoptables, or customs. Only I, as the original creator, retain the right to develop species from my own work.For ownership, if the character is not being posted on ToyHouse, please inform me of the new owner if the character is ever traded, resold, or gifted. I must always have access to the ToyHouse profile of my designs. If you delete or privatize the profile, or if you remove design credits, you will be blacklisted. If you re-upload the character’s profile, you must credit me again.I do not authorize my artwork to be used for AI training, NFTs, or any related technologies. Any misuse of my work in these ways will result in a permanent ban, blacklisting, and I reserve the right to pursue compensation or legal action for damages caused by the unauthorized use. Additionally, all of my artwork is fully human-made from scratch. I do not use AI in any stage of the process, nor do I incorporate AI-generated content or influences into my work.I reserve the right to request valid ID when necessary, especially for commissions that may involve sensitive or mature themes.Finally, I do not accept commissions from minors. Payment processors such as PayPal require users to be of legal age, and I must comply with their TOS. If I discover that a client is a minor attempting to commission me, especially with mature or sensitive themes (such as gore), I will cancel the commission and block the client. Minors may only commission safe-for-work art if they have the express permission and involvement of a parent or legal guardian.
